This legal notice governs the use of the website pensamientosdecolores.com (hereinafter, "the website"), made available by Pedro J. Mas Penedo to internet users. Browsing the website confers the status of user and implies full acceptance of all clauses included in this Legal Notice.

Users agree to make appropriate use of the content and services offered through the website, and not to use them to engage in unlawful activity or activity contrary to good faith and the applicable legal order; to spread content or propaganda of a racist or xenophobic nature or that promotes any form of discrimination; to cause damage to the systems of the owner or third parties; or to attempt to access or use other users' accounts without authorization.

1.4 Intellectual and industrial property

All content on the website — including but not limited to texts, photographs, watercolor illustrations, graphics, images, design, logo and source code — is the property of Pedro J. Mas Penedo or is used with the corresponding authorization of its authors, and is protected by intellectual and industrial property law. Full or partial reproduction of the works and commissions shown on this site is expressly prohibited without prior written authorization from the owner.

1.5 Limitation of liability

The owner is not liable for any damages of any kind arising from the unavailability or discontinuity of the website's operation, nor for damages caused by unlawful, negligent or fraudulent use contrary to this Legal Notice. The website may contain links to third-party sites (Instagram, Etsy, WhatsApp) over whose content the owner exercises no control and assumes no responsibility.

1.6 Governing law and jurisdiction

These terms are governed by Spanish law. For the resolution of any dispute arising from access to or use of the website, both parties submit to the Courts and Tribunals that correspond by law, and, where the user has the status of consumer, to those of the user's domicile.

2.2 What do we use your data for?

Personal data you provide through the contact form, WhatsApp, email, or the newsletter sign-up form is processed for the following purposes:

  • Handling your enquiry or quote request and managing your custom watercolor commission.
  • Sending you, if you have voluntarily subscribed, communications about news, new work or promotions (newsletter).
  • Complying with the legal and tax obligations arising from the business relationship, where applicable.

2.3 What is the legal basis for processing your data?

The legal basis for processing your data is the consent you give by filling in and submitting the contact or newsletter form (Art. 6.1.a GDPR), and, where applicable, the performance of a contract or pre-contractual measures (Art. 6.1.b GDPR) when the enquiry leads to a commission.

2.4 How long will we keep your data?

Personal data will be kept for as long as the business relationship is maintained or until you request its deletion, and in any case for the periods legally established to address any liabilities arising from the processing (generally, the limitation periods for civil and tax actions applicable in Spain).

2.5 Who will your data be shared with?

Data will not be shared with third parties except where legally required. The following providers act as data processors in order to deliver the service:

  • Netlify, Inc. — hosts the website and processes contact form and newsletter form submissions.
  • Google LLC (Google Fonts and Google Maps) — serves the site's typefaces and, on the contact page, the location map.
  • Google LLC (Google Analytics) — for statistical purposes, collects aggregated browsing data (pages visited, time on site, traffic source, device type) to understand how the site is used and improve it. This processing is based on your consent (Art. 6.1.a GDPR): it only activates if you accept the corresponding cookie banner, and you can refuse it or opt out at any time, either by rejecting analytics cookies in that banner or by installing the Google Analytics Opt-out Browser Add-on.

Some of these providers may be located outside the European Economic Area; in that case, the transfer is carried out under the safeguards provided for in the GDPR (standard contractual clauses or another equivalent mechanism).

2.6 What are your rights?

Anyone has the right to obtain confirmation as to whether Pensamientos de Colores is processing personal data concerning them. Data subjects have the right to:

3. Cookie Policy

3.1 What are cookies?

Cookies are small text files that a website can store in your browser or device. Strictly speaking, this website does not use its own cookies for analytics, advertising or tracking purposes.

3.2 Technical storage we do use

This site uses browser local storage (localStorage), which is technically not a cookie, for two strictly technical purposes: to remember whether you have enabled the site's dark mode, and to remember the choice you make on the cookie banner (accept or reject analytics), so it isn't shown again on every visit. This information never leaves your browser, does not identify the user, and serves a strictly technical/functional purpose — under AEPD (Spanish Data Protection Agency) guidance on cookie use, it does not require your prior consent.

3.3 Third-party services embedded on the site

Some third-party elements loaded on certain pages may set their own cookies or receive technical data (such as your IP address) independently of this website:

  • Google Fonts: the site's typefaces are served from Google's servers.
  • Google Maps: the map embedded on the contact page is loaded from Google's servers.
  • Google Analytics: installs its own analytics cookies (not exempt from consent) to statistically measure site usage — pages visited, time on site, traffic source and device type, without identifying you personally. It only activates if you accept the cookie banner; until then, the Google Analytics script is never loaded. 3.4 Future changes

This site has Google Analytics installed, gated behind prior consent from the cookie banner (see point 3.3).
